Terms of Service

If you have a problem with any of these statements, they may be changed if discussed with me prior to ordering your commissioned piece.

1. GENERAL TERMs

The amount of commission slots may vary by season.

All drawings will include a subtle signature that you may not remove.

Prices are subject to change based on demand.

I have the right to reject any commission that I do not feel comfortable drawing for any reason.

I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.

By purchasing any of my services, you are agreeing to my Terms of Service.

2. PAYMENT

Currency accepted is either USD and can be paid by buying the commission directly in my Ko-fi (Paypal/ Credit card), or CLP through national bank transfer service or Mach, requesting the commission requesting the commission through a form on my website.

All commissions must be paid in full upfront.

Any extra charges, for exceeding 5 revisions or changes in the complexity of the commission, must be canceled before sending the finished work.

3. PROCESS
AND
DELIVERY

During the reviews, you will see work-in-progress and these images will usually include a watermark and be smaller than the finished piece.

The time it takes to finish your commission varies 1 - 4 weeks, depending on factors such as health, complexity of commissioned piece, other work and con seasons. If anything comes up that will slow down the estimated delivery time initially, I will let you know as soon as possible.

Once the piece is finished you will receive the full-resolution image in A5 size PNG file. Except for the emotes that will be delivered in the sizes 400x400px, 112x112px, 56x56px and 28x28px.

Please note that there is no physical product. Depending on where you live, we can arrange the printing of your artwork and subsequent shipment. Just ask me.

4. REVISIONS

Amount of reviews depend on the complexity of the work, but will not exceed five reviews. After this, they will have an extra charge depending on the commission.

If you exceed 5 revisions or want me to change something in the drawing that you were previously happy with, I will charge you an extra fee. The amount of the extra charge will depend on the complexity of the change you want me to make.

5. COPYRIGHT/ USAGE POLICY

I, the artist Patricia Orellana, a.k.a. Jandi no iro, I retain all copyrights over the commissioned illustration and its use/distribution, but I will NOT claim intellectual property (IP) in the Illustration.

I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.

I might record the drawing process and post it on my YouTube channel, if I consider it convenient (You will be informed in that case).

You (the customer/commissioner) is allowed to use the commissioned piece for personal use (yes, you can upload it on all your social media profiles), but not for commercial use.

Use the artwork on their Youtube/Twitch channel and in monetized videos as long as the artwork itself is not the main reason for the earnings. You are not forced to give me credit when you post it, but I would appreciate it very much.

You retain the rights to the intellectual property (IP) of the character(s), but not the artwork itself.

You are not allowed to claim the artwork as your own, remove my signature, edit, copy, or reproduce/use the illustration commercially without my consent.

7. REFUND/
CANCELLATION
POLICY

You (the customer) can cancel the commission at any time, but you must take into account that if I have already started working on the commission, you will not receive any refund.

If for any reason I have to cancel your commission, I will give you a full refund.

If I have to give you the refund, please do not request the refund from Ko-fi, Paypal or the Bank. I myself will return the corresponding money.

If you request a chargeback at any time without consulting with me first, you will lose all of the aforementioned rights to the commissioned part and will not receive a refund.

If the buyer breaks any of the points stated above they will lose all before mentioned rights to the artwork commissioned by me, the artist, and I will have the right to profit further from the commissioned artwork in any way I see fit.
